Voluntary participation
I understand that I am voluntarily participating in a recreational boat tour and may choose not to participate in any optional activity, including swimming, floating, boarding at a stop, or entering the water.
Inherent risks
I understand that boating and water activities involve inherent and other risks, including slips, falls, vessel movement, wakes, weather, sun exposure, heat, dehydration, drowning, marine life, submerged objects, collisions, equipment failure, illness, injury, disability, and death.
Health and ability
I represent that I am physically and medically able to participate safely, or that I have disclosed relevant limitations to the captain. I will not participate while impaired in a way that creates a safety risk.
Safety instructions
I agree to follow all instructions from the captain and crew, use handholds, wear a life jacket when directed, remain within approved areas, and enter the water only with captain permission.
Assumption of risk
I knowingly accept and assume all risks of participation, whether known or unknown, inherent or otherwise, to the fullest extent permitted by law.
Release and covenant not to sue
To the fullest extent permitted by law, I release and agree not to sue Boat Happens, the vessel owner, captain, crew, contractors, agents, and affiliated parties for claims arising from ordinary negligence or the inherent risks of participation. This release does not apply where prohibited by law or to conduct that cannot legally be waived.
Indemnification
I agree to be responsible for claims, losses, or costs caused by my own conduct, my violation of instructions, or damage caused by me or a minor for whom I am legally responsible.
Emergency assistance
If I am unable to consent during an emergency, I authorize reasonable first aid and emergency assistance. I understand that I am responsible for my own medical, transportation, and related expenses.
Minors
A parent or legal guardian must authorize participation for a minor and accepts responsibility for supervising the minor. The adult represents that they have legal authority to provide that authorization.
Personal property
I accept responsibility for phones, cameras, bags, clothing, and other personal property. Water exposure, loss, theft, or damage may occur during boating activities.
Knowing agreement
I understand that a final signed waiver is a legal agreement affecting rights. I will review it carefully, ask questions before signing, and will not participate unless I agree voluntarily.
